    since when does losing property for violating an ordinance equal imminent danger of losing one's life?

    Homeowners association president Ed Zisman said Wirth has been "a very difficult person" to deal with because he continued to walk his dog without a leash even though he was repeatedly told not to do so.

    he was fined repeatedly-and his house is being foreclsed on by the HOA as he refuses to pay the fine or follow the rules he agreed to by joining the HOA.

    Meanwhile, Wirth's frustration has escalated. He said that he would shoot and kill one of the board members if things don't go his way.

    "I am not going to let them ruin me and my wife like this without standing up to them," Wirth said.

    He argued that he has the right to do so under the state's Stand Your Ground Law, which basically says someone is justified in the use of deadly force to defend themselves if they believe they're in imminent danger.

    Wait, why does a HOA have the power to put a fucking lein on your house? This is one of many reasons that HOAs should be outrightly banned. Too much power, too little thought.

      On the one hand, I'm in shock. On the other I'm laughing my ass off.

      If he thinks a legal foreclosure is "Imminent danger", I will happily demonstrate to him what that phrase really means. All this guy did was make a charge of issuing a death threat easy to stick. (And for those of you who think such a charge can't work, check the wording in the PATRIOT Act. He can be declared a terrorist for that threat.)

        ahh it's called free will young padawan-don't like the HOA guidelines, it is a legal and binding contract-simply don't buy the house and don't sign the contract.

          I hate the idea of an HOA. If there is a major problem then a city ordinance should be used. Also note that a lot of city ordinances have the same rule about dogs being walked on leashes. If he was in a city doing that he would have gotten a ticket not a lien. I don't agree with the lien. Ding his credit or take him to court but a lien?

          I would like to see how he is imminent danger. All he has to do is pay the fine to get rid of the lien. He also made a death threat which was is illegal before the Patriot Act. It just allows for a person to be called a terrorist and get a harsher prison sentence. A

              I'm presuming that when Wirth bought the place, he was shown all the relevant bits of ordinance and the like, and he signed it. Thus, he agrees to follow the rules, accepting that if he doesn't, there will be consequences.

              He didn't follow the rules, here are the consequences.

              Thus... don't go whinging to mummy cos you don't get your way! If he didn't like it, he shouldn't have moved there (or, made a court hearing to declare the act unlawful, and infringing on his rights... certainly the comment there about 'painting a house the wrong colour' would fall under that...)

                and this my friends is why you NEVER buy anything in a HOA ever ever ever ever ever

                even if they are normal resonable people now, all it is going to take is one nutjob to move into the HOA and get onto the board for it to turn into a prison.

                  dear God let's not.

                  The thought of depending on the government to regulate neighborhoods is terrifying... HOA's are far from perfect, but a well regulated HOA (like what they have in Nevada, thanks to NRS 116) will be much more effective than trying to get the government to actually do it. Good example, fire safety. My mom has a neighbor who refuses to clear out dead weeds, leaves, etc and refuses to keep the required clear zone. She called the fire department... no result... about all the fire department could do was to send strongly worded letters... the HOA on the other hand was able to use the threat of fines and collections to actually force the home owner to remove the threat. I'll take the HOA over the government any day.
