  • Burgler sues victim for injuries sustained in citizen's arrest

The burgler, Michael Dupree, says the citizen arrest hurt him

Mr. Dupree had possession of someone else's bike. The owner of said bike & 2 friends find Mr. Dupree and puts him in shoulder hold until police arrive. Mr. Dupree's memory of said citizen arrest is very much different.

Yes, everyone is a victim now. (note: sarcasm).

Why doesn't the burglar sue the government for not giving him everything.

He won't win. At all. He would never be able to prove that it was that citizens arrest that caused it. Not when the defense will be able to prove that that piece of shit was a cocain user, found naked and high as a kite when arrested.

It's going to be a sucky fight. But he won't win. Especally not 500,000 dollars.

If anything, he should be countersued. It could be proven that seeing one's car being broken, his prized bike that he has for years and was given to him after the death of Bikey, his pet kitten as a memorial, and to see a naked man ride it in glee was basically disrespecting the dead.

Yeah, the above didn't happened. But yeah. That piece of shit won't win, and it'll be laugh at out of court. When he tries to redo it at a higher court and higher court and higher court, (Much like the Pant's lawsuit asshole), it'll eventally be taken to the Supreme Court, they'll all laugh at him in a giant massive laughter, and he will never be able to sue that guy again.

This sounds so typical. I actually wouldn't be surprised if this jackass won. Still, the mere fact that he has to go through the courts is outrageous enough.

What bothers me most is that we'll probably never know how it turns out. FILING a stupid case makes the news; losing one rarely does.

I once served on a federal jury in a case where the convict was sueing the state governor, the entire state legislature, state director of corrections, the warden and all prison personell because the nurse would only give him 12 inches of dental floss at a time. He wanted a whole role but later it was revealed that he had a habit of using dental floss as a weapon. He didn't win.

The vast vast majority of these type of cases are just vacations for the convicts.

I hope the burglar loses big on this case. He was committing a crime. He should not be able to sue for injuries suffered during the crime. He'll have a court date already wherein he would be able to state his side of the story and ask for leniency due to the excessive force used in his subduing.

I must disagree with this. This would allow me to legally injure someone who committed a non-violent theft against me to the point of making them a paraplegic. While I am fairly draconian with the punishments, I'm also a big defender of the concept of due and equal force.

Exiled, just so you know, don’t move to TX and try to commit a robbery there. They believe really heavily in the mentality of “my home is my castle. Don’t mess with it”. They do have the right to shoot at you even if you are fleeing after attempting a break in. It’s a pretty simple fix on the criminals part. Don’t steal someone’s stuff and you wont be shoot at.

Look at this case, they guys naked, breaks open a car window to get at a bike, and wants to complain because they put him in a shoulder hold. Oh poor druggy, he just wanted to go live in a nudists colony with someone’s bike. Why wont people let him have the stuff he wants?

                    What he wants: $500.000
What he ought to get: A good flogging to teach him not to be Stupid In Public. Then, back to prison to serve those 12 years.
