    Your analogy is flawed.

Plastic cups aren't inherently associated with alcohol.

But bongs are inherently associated with smoking and drugs.

    Are they legal in Florida?

Because that's the only state that matters in this case.

EDIT : I didn't see Greenday's last post before posting mine. All right, then. If they're illegal in Florida, then that's it. It doesn't matter if they're legal elsewhere.

Yep. We have a winner. Well, a loser really in this case.

Assuming of course, they can prove the picture was taken IN Florida. (Which they should be able too).

Well, its shame that a mother can take a goofy picture and get in trouble over it because people fear weed for no real reason.

Regardless of whether weed should or should not be legal, the fact is that marijuana is currently illegal in the United States. Paraphernalia is currently illegal in the state of Florida. This mother was not only stupid enough to allow her child to play with an illegal device commonly used to smoke an illegal product, she was also stupid enough to take a picture of it and post it on a public forum.

She brought this on herself, and I have no pity.

You know, when I read the title, I thought I was going to be siding with the woman. I mean, being arrested over posting a facebook photo? I thought we had freedom of speech? Well, that was before I saw what this photo was, proof of child neglect and utter stupidity on her part.

            Epic fail lady!

Not sure if you realize that cops these days use facebook for a lot of stuff. They can search facebook and find underage parties to bust up too which they do all the time.

On-topic: the lady... was a moron. 'Oh, let's put this in an infant's hands and take a picture when he puts his mouth on it! It'll be cute!' No, bitch, it'll be the start of a whole world of shit for you and your family because once law enforcement gets ahold of the pictures, you're gonna have a lot of questions to answer. Enjoy your imminent custody battle.

As far as the argument over bongs, the reason they're still allowed to sell them in most places is because they put up the illusion that they're meant for tobacco, even though the general public knows better. They're not even referred to as 'bongs' here in SA; they're just called 'glass pipes'.

On a semi-related and funny note, I stopped into a convenience store mid-errand-running one day because I was out of smokes, and I noticed that they had corncob pipes for sale for $3 each. I was wearing a pair of paramedic's fatigue pants that I'd found at a thrift store because I was out of clean pants and had washed and hung up my jeans before we left.

Somehow I got asked if I was an off-duty police officer. Once I told her 'no, I'm not even a cop', she asked me if the corncob pipes were good to smoke weed out of.

Look. The person in question was a complete freaking idiot to put something like that in the hands of a child (at the very least it's breakable glass) and take a picture of them. The person in question was an Olympic-Sized fucktard for posting such a picture onto a social networking site where ANYONE could see it.

People from the Middle East use a water pipe (which a bong is a primitive version) for tobacco. Not to mention that there are people who enjoy pipe-tobacco from them. Not to mention there are the "legal" (for now at least) herbal blends that people smoke and smoke through water pipes.

There is a large counter culture covering their use. Some places here in the US are legally allowed to sell them because they have non-illicit-drug uses. Some places do not allow the sale of them. Sunrise and Silver in New Hampshire Used to sell them, Sunrise Tie-Dye in Cambridge MD sells them.

The issue here is not the legality of the item. The issues here are...

                      1. This was a stupid thing to do
                      2. Posting this on Facebook was even dumber
                      3. The possibility of drug use (not yet proven) by the mother (the child was clean)
“There are worlds out there where the sky is burning, where the sea's asleep and the rivers dream, people made of smoke and cities made of song. the one thing that REALLY bugged me when I first read the article and saw the actual picture was the fact that it appears as if there is smoke in the bong (maybe just cloudy glass or they have not cleaned the thing in a long time)
I'm lost without a paddle and I'm headed up sh*t creek.

And I like how his hands are.

Even his hand on the base, like he is using a lighter.
