Me thinks she be smoking something other then weed at times, if those meth sores are anything.

While there may be nothing legally wrong with taking a picture of a child holding onto something that could be used as a bong (after all, there is a reason that shops can sell them legally at least in the State of Maryland).

But regardless of whether or not a crime has been committed, there is sufficient evidence for poor judgement, poor parenting, and just out and out "Whiskey Tango Foxtrot where you thinking you idiot?!?" going on there.

Even if she is not arrested, I feel that the parenting and drug counciling is a good start. Take the kid away until she's earned her "First Year Clean" pin would be even better.

Me thinks she be smoking something other then weed at times, if those meth sores are anything.
I'm going to hold judgement on whether or not they're meth sores since they look more like acne sores to me. My friend in Virgina looks like that (with the facial blemishes). Worse in fact. And I know that she hasn't had any meth in her life.

I do agree however that she has to have been @#$%ing stoned to think that that was a good idea.

If it is a pipe for tobacco then she shouldn't be arrested. Sure it is kind of a dumb picture to take but parents take dumb pictures of their kids all the time. It doesn't mean she is a bad parent or anything.

It's a bong. While you could technically smoke tobacco in it....c'mon, it's a bong. That, plus the fact that she's in drug counseling, suggest that she was not just smoking tobacco in her "water pipe."

I'm with Admin. It's a bong. And no one actually smokes tobacco with a bong.

So people should be arrested for having legal items that could be used in illegal ways?

Pretty sure possession of paraphernalia is a crime.

It's not. Not in all states. Perfectly legal to own bongs/pipes in alot of places.

Hell, there is a HUGE shop here in Portland, devoted to nothing but pipes and bongs, clothes made of hemp, a place where major rallies are for legalization of weed.

Bongs aren't illegal though, they can be bought in stores and used to smoke legal substances.

I think it was more the supposed intent and personal history behind it.
And it's also a matter of "What if?"
-What if the bong had had marijuana in it?
-What if the mother was allowing the child to play with the bong when it was in use?
-What if the mother had been smoking around/towards the child?
-What if there are more drugs in the house? After all, the baby got their hands on the bong so it's obviously not stored away safely, so who's to say more drugs or dangerous items aren't just laying around?

I know most people who knew the mother might say that the chances of these are pretty slim, but it is there as demonstrated by the photo.
The young mother has since been sent to parenting and drug counselling classes, so someone does think there was a problem.

Although, this sort of reminds me of this.

People should be arrested based on "what if"

My parents get alchol in the house when I was a kid.

-What if they got me drunk every night
-What if I stole it and then stole their car and drunk drove
-What if they also had dangerous things like drain cleaner or antifreeze in the house
-What if for booze money they sold me to a Saudi Prince and I was forced to live in his harem
-What if they threw a drunken party which got out of hand and resulted in the entire city being set on fire
-What if they invited Indiana Jones over to exchange a diamond and posioned his drink and made him give it to them before giving him the antidote

Oh dear, look at all those possible scenarios. Its a wonder they weren't arrested.

Except in the case in the OP, there was legitimate evidence that something untoward was going on in the house hold. Someone was concerned by the picture that put a child in contact with something generally used with a controlled substance and felt that the child could be in danger. They reported their concerns to the local authorities who felt it was a serious enough case to investigate and charge.

Your scenarios have nothing to do with the OP. Except to make me think you are drinking right now while watching Indiana Jones and playing with a lighter.

In the picture the tobacco or whatever as well as the tray that would be used to hold it were removed according tothe woman's explanation. It would be like reporting under aged drinking because of a picture of somebody holding a plastic cup. If theres nothing ilegal going on then nothing illegal is going on

Well, lucky for us, this is a clear cut case. Possession of paraphernalia IS illegal in Florida.
