        that's would be true if it was actually the case here. this particular situation is not a case of ignorance of the law, but rather being deliberately misled into something that he believed to be legal.

          Not making baseless accusations. More like he did knew, and when caught lied by screaming she gave fake ID and all that. Where was the ID card at the time? How long were they dating? Did she ever slip about her age? Did she skip school the entire time they were together so to as not have to go to high school, or did she say her high school was a college?

          Too many ways and signs that would have shown she was not the age she claimed if he waited more then a day or too to jump into bed with her.

            She DID lie about her age, she DID have a fake ID.

            You're out bowling with a couple buddies, you find some girl, you hit it off and you take her back to your place. She looks borderline but she has ID saying she's 18 or older. All of a sudden, the police are at your door a few days later. BOOM! Statutory rape. It doesn't matter that she lied about her age. It doesn't matter that she had a fake ID. In the eyes of the law, you should have known anyway. Why would you think you'd need more proof than was already given to believe she's old enough to consent?

              ^Exactly, Greenday. I don't know the whole story of that particular case, but from what I remember, she had the fake ID BEFORE she met him. She was doing it on purpose so people would believe she was older. It could have been in the summer. 19-year-olds can still live with their parents OR a 16-year-old could live on her own....it's been done.

              That's the kind of thing that makes me think statutory rape laws should be...changed a lil. At least to cover where the girl or guy deliberately lies about their age. I mean...why would you not believe them when they actually HAVE an ID that shows they're of age?

                Fine. You want to sleep with a woman first day you met her before you know anything? I feel even less sorry for him. He jumped in without thinking.

                Not all people are trained in spotting fake ID's. He took the chance, and got screwed over. Completely his fault. He thought with his penis first.

                Do men have to pay child support if he gets a woman pregnent even though she claimed she can't have kids? Yes.

                Do people still get STDs even though their partner claim they're clean (Even though they aren't) Yeah, big possibly.

                I get that sex is awesome and people love it, and it's part of human nature.

                But it's also something you need to be careful about. Be it ether partner has flash backs of worst times and starts screaming no/stop and the other doesn't because that's how their partner claimed they wanted it, be it to prevent pregenancy, be it to keep yourself safe from STDs, you need to be careful and save your own ass, and not just take the word of a stranger. Which is what he did. She claimed she was 19, and showed a fake ID that he likely couldn't know was fake or not. All this within what, 8 hours after he met her? He got laid, then got fucked. Completley his fault.

                  That's a little different and obviously one of those stories people pull out of their wallet and back pockets in cases like this where they want to prove their belief that older guy + younger girl is not necessarily rape or worth being called a sex offender.

                  Most underaged girls don't go through that much effort to get a guy in trouble. And honestly, that girl probably wanted more than just a guy if she wanted to make herself 19 years old. If anyone wants to believe that she did it just to hook up with older guys and get them in trouble, it's time to take off that tinfoil cap and step away from the computer, because that sounds like a crazy episode of Law and Order SVU.

                  And as far as the younger girl going after the older guy, that doesn't make it right, either. Being the legal adult, you need to take responsibility and say "No" if an underaged girl is persuing you and cover your ass. I never noted this earlier in the thread, but even though I have painted most young girls out to be impressionable and naive, I will also add that they can and do cry rape or try to manipulate relationships with older guys, blackmailing with threats of crying rape or telling her parents if she doesn't get what she wants. This is why it's best to stick with people your own age, until you are both legal adults and age doesn't matter any longer.

                    She instructs him to drive her to a local college that is near the high school that she actually goes to (and making sure that it's not the college that he goes to). After he leaves, she heads over to her high school.

                    Presuming that he is a college student himself, and perhaps has a job as well, there are going to be large stretches of time when he simply couldn't see or talk to her, which gives her a lot of room to cover up any activities that a 19-year-old wouldn't be doing.

                    With care, and a bit of luck, a person could keep up a cover like that for a long time.

                      Where was her fake ID for the court? If it was his defense, he'd likely have others back it up, like the bowling area that saw it, or any other place where she had to show ID.                         Oh, I agree with you, that one's more of an out-there WTF case, but it does happen, and I think something needs to take that into account. I mean...you could be sticking with people your own age, but if someone looks older than they are and has a fake ID that says they're of age, well...it's kinda hard to know what the hell to do when you find out she [or he!] lied.

                          There's a difference between hooking up with some child who obviously isn't 18 and hooking up with someone who looks borderline but has ID saying they are 18 or older. The fake ID thing was never disputed back when it happened so I assume it's true or else the girl and her family would have denied it. I don't have the court transcripts so I can't tell you exactly what happened. But honestly, it's not a case of "Well, she TOLD me she was 19..." She had ID that proved it. Expecting everyone to know how to spot a fake is ridiculous.

                            He made the choice. He saw basically a piece of paper that said she was 19. Since they are easy to make, and even easier if it's an out of state one, that doesn't PROVE she's 19.

                            I find it even wierder that moments after they met and had sex, he asked for an ID card anyway. He very likely just glanced at it noded and went for it.

                              If they're so easy to make, why did I never have one?! People go by IDs. Everyone does. The average person cannot spot a fake unless it's REALLY obvious [i.e. I could spot like...crayon ones. If there's any level of professionalism in it, unless they fucked up big time with something I know should be on there--I know I sure as hell won't spot a fake ID]. She had a professionally made fake ID that said she was 19. What on earth is he supposed to do, track down her parents and get an original birth certificate and social security card? People don't do that. I sure wouldn't want people doing that...since I know I look way younger than I really am, I'm 22 and people have mistaken me for 12. If I have an ID that says I'm 22, I'd really prefer people not question that. So why should he have questioned that her ID said 19 if she even looked 19?

                              There's a difference between just deciding to fuck a girl and not caring how old she is or if she's lying and seeing ID that "proves" she's of age and only finding out later she had a fake one. Unless everyone here not only cards all of their partners, they get original birth certificates or something.
