So...basically the whole time he was getting a Mountain Dew, he was really just getting it for the bully, wasn't he. Since the bully was obviously entitled to just grab stuff out of his backpack.

Exactly, Lace Neil Singer. Don't steal someone else's food or drink, no problem. Do, and it's your fucking fault if something happens that you don't like.

I never said that. All those times when he had Mountain Dew, it was for himself. The day he brought piss in, it was obvious it was meant for the bully. If I'm on a jury and they the defense tried to say it was for himself, I'd be thinking, "Oh, so you think I'm retarded, GTFO"

TAKE it, yes. DRINK it, not necessarily. It would be reasonable to assume that the appearance, behavior, and odor of urine are sufficiently different than Mountain Dew that the idiot would have noticed before ingesting.

At what point did "Brian" ask for the bottle?

If this is a real incident, and "Brian's" parents decide to sue, they may very well win due to the malicious intent factor. That doesn't mean they'll get much.
The defense could argue that, if "Brian" hadn't had a habit of stealing from "Todd," then "Todd" would never have had the idea to replace the soda with urine.

Anyway, isn't Mountain Dew more greenish in color, and opaque? Assuming "Todd" was healthy, wouldn't his urine have been a translucent light yellow?

Yes. Everybody's getting their panties in a bunch over what will almost certainly prove to be some sort of net prank.

Um. Is a net prank. Not maybe. Not certainly. Is. We're just having fun with a hypotheoric debate, basically at what part can a person do against a bully. Defending their items seems right out, so no home alone hilarity.

Strange how long this been around, and yet not a single real news deal on it. No schools. No last names. Not really even a city. Just off hand sites like Fark and Digg and myspace are where it's posted.

I think the bully got what he deserved. I feel no sympathy whatsoever. He put himself in that position by stealing the other kid's soda. End of story as far as I'm concerned.

I'm sure it's a net prank; however, it might be based on a real incident.

As I said in my last post, I did something similar (replacing Coke with vinegar) to get back at a bully. However, vinegar, no matter how icky tasting, happens to be a food item and urine isn't.

Is the story a fake? Yes, absolutely.
Disregarding this: did the bully deserve it? Yes, absolutely.
Was it "right" - i.e., legal - of "Todd" to do it? No, absolutely not (local laws may vary, of course).

Why not? Well, taking the soda from "Todd's" backpack is illegal (theft or mugging), but taking someone else's lunch from a company fridge is also illegal (theft). If you aren't allowed to boobytrap the latter, then you aren't allowed to boobytrap the former, either. Both require an illegal action on the part of the bully to acquire from the victim. Whether that action is mugging or theft, doesn't make a difference for the case of boobytrapping: the "trapper" still intends for the (potentially) harmful substance to be ingested by the bully, and thus, it's illegal.

What should "Todd" have done instead? Well, one option would be to have a friend film the instance of the bully taking the piss... I mean, the Mt. Dew, of course, and use this as evidence to give to school officials. Possibly shoot several videos to prove the regular occurrence of the mugging. That would make it a lot more difficult for the school to continue ignoring the bullying.

Nah, given how schools tend to operate with regards to bullies, Todd would be suspended/expelled for violating Brian's right to privacy.

                        .
There is a big difference between boobytrapping something you keep on yourself versus boobytrapping something you put in a company fridge.

The bully absoultely had to force the item away from Todd to drink it.
Putting in the fridge would be illegal, because people can accidently take it at that point. By confusing it with their own. There is a subtle difference between the two.

Replacing the drink with a food item would have worked a lot better; maybe something yucky but harmless like cold tea.

Or mixing orange juice with Dr. Pepper.

My roommate did that...actually kind of liked it.

Since people want to bring legalities into this argument, I raise the question of whether or not he tampered the drink. The story says that he drank it the soda and then refilled the bottle with his urine. Is that technically/legally tampering?
