    how about this? you owe money to someone. you pay him back. unbeknownst to you, the same day your wife pays him back as well. he says nothing and you don't find out until you get home later in the evening.

    is the person you owed obligated to give you back the overpaid money, or do you just say "tough shit, i should have watched the money better" and let it go?

      A family member of mine received a larger tax refund than expected. Assuming she made a math error and hurray the gov't caught it, she spent the extra money on bills. A few months later, Uncle Sam realized they made a mistake and demanded their money back immediately. Was it fair or my family member's fault? Of course not. But it also wasn't her money to spend and you better believe Uncle Sam got it's money back.

      If it were a private company, I'd still expect them to sue and get their money back. But since it was government funds that paid the woman, you're damn right they'll get the money back.

        Legal and moral are two separate things here. I don't believe that it is legally stealing.


        What I'm curious about (let me know if I missed this or not) is if the discovery of her still getting paychecks led to her being fired of if she had been fired but the paperwork to list her as fired was never put through in order to stop her paychecks. It would at least be a small difference. I know that in non government jobs, they can decide to fire you by just not putting you on the schedule anymore. I'm wondering what kind of "you're fired" notification her employers legally needed.

        As far as the time sheet thing, my time sheet is only for recording time off or overtime. If I don't fill it out, I get paid as if I worked my regular 40 hours.
