  • Adult children's 'bad mothering' lawsuit dismissed

    Raised in a $1.5 million Barrington Hills, Ill., home by their attorney father, two grown children have spent the last two years pursuing a unique lawsuit against their mom for "bad mothering" that alleges damages caused when she failed to buy toys for one and sent another a birthday card he didn't like.
    In 2009, the children, represented by three attorneys including their father, Steven A. Miner, sued their mother, Kimberly Garrity. Steven II, now 23, and his sister Kathryn, now 20, sought more than $50,000 for "emotional distress."

    There is a special place in hell waiting for these people, that poor woman, I really feel sorry for her.

    Raised in a $1.5 million home by their father, the children alleged the Garrity was a lousy mom because she failed to send money for birthdays, called her daughter home early from homecoming, and threatened to call the police on her son, then 7, if he didn't buckle up in the car.
    One of the exhibits in the case included a birthday card that Steven called "inappropriate" because it failed to include cash or a check.
    "This is just me surmising, but this looks more like the husband trying to get back at his wife. It doesn't look like an impartial lawsuit," Ottley said.
    Ottley is a law professor at DePaul University and author of Illinois Tort Law.

    I don't know when the couple had been married, but they divorced in 1995, and I agree with Ottley that it was likely a case of the father using the kids to try to attack the mother.

      wow...are you kidding me? Yeah it's a good thing the lawsuit was dismissed cause it's utter BULLSHIT. A card is inappropriate cause it didn't have money in it? someone in that group is a greedy little bastard.

          I don't know what to add to this accept to agree with gremcint that there is a level of hell waiting for these two when they finally binge on too much of their own feces, which I'm sure they must think tastes like cinnamon buns to behave this way.

          I don't care if the father single handedly got every charge against Charles Manson dropped today. I really think the mother should counter sue for the amount of time that was wasted and for defamation of character. And part of the damages should include the right to give her kids the paddling upside the ass that they clearly must have needed for even considering doing this to her.

                What the FUCK?! Opportunism, greed and nastiness of the highest order, no doubt spurred on by dear ex-husband.

                They have no fucking IDEA what emotional distress is. My mum sees kids whose parents have caused them emotional distress by beating them senseless every day, not to mention those kids who are abused by parents on a regular basis. THAT is emotional distress, not getting a birthday card that didn't contain money.

                I've no doubt the father is to blame in some part of this. He told the greedy fuckers that they had a case! All that horse shite (and that is what it is) about dissuading them...if he really wanted to dissuade them he'd have told them to go fuck a duck and not do an OUNCE of research. This was a petty and disgusting revenge ploy for him, and I'm glad to see it failed.

                It says a lot about the generous nature of that woman if she's able to say she still loves them after all this. Hell, she is a better woman than me, because if my children made those ridiculous allegations against me, I would disown them.

                Greed and pettiness are obviously alive and well. Shame on all 3 of them!

                  Am I the only one who finds this fucking hillarious?

                  I mean this sounds like something right out of the Rugrats (remember the episode where Angelica sued her father for making her eat vegitables?). Only it's even more ridiculous and actually real.

                  These kids can't be serious. Is anyone that stupid to believe they could sue for such petty bullshit? (and petty is putting it mildly).
