Aside from the sexism thing, the cops were assholes, too.

Did they seriously have nothing better to do? Not to get into detail, but as a younger, wilder person I've been caught in a similar position and the cops just said 'move along'.

I'm not defending them. It was wrong. But, I also think it would greatly depend on the juristiction you're in because most cops around here would just move on unless they were Barney Fife wannabes.

there's probably rules about fraternization between secretaries and lawyers in regards to the firing. Also in regards to treatment, the Lawyer could sue and cause more trouble than the secretary and who has worked at the firm longer? maybe there is a seniority thing related to how they are being treated, I can think of several scenarios that would lead to this treatment aside from sexism.

Actually it doesn't automatically scream sexism because he is a lawyer and she was a secretary.

Her job is more likely to be At Will employment which means she can be fired for misconduct, however his job is more likely a contractual one and they would have to handle misconduct per his contract which may specify forced resignation versus firing.

So, you say it's not illegal, and immediately afterwards say cops will tell you to stop doing it and you could get fined... making it illegal.

The fact that it wasn't just any parking garage but was a courthouse parking garage probably has some bearing on the situation too.

Also I'm curious as to if it was in a car or just in the parking garage.

If he was in a union or had a contract that stipulated certain things about how he could be fired then it may be that they wanted them both gone but that was the best way to fire him.

While it was their off time, that doesn't always matter. The police I work with could be disciplined for something like this. Some jobs have a clause about stuff like that.

According to the OP the guy is a state attorney, that means he's politically connected to someone further up the food chain. I'd dare say the secretary doesn't have similar connections. The LEOs busted them because they don't like lawyers any better than anyone one else and most likely less.
