That would be his idea. If you have no idea during the fact, and don't find out about until well after the fact, it shouldn't really affect you and therefore should be legal.

Because his comments were 1) off the job, and 2) Universities defend the academic freedoms of their faculty even when the speaker is a complete dickhead asshat.

And I agree with the University. People should not lose their jobs for being assholes in public. There are other ways to deal with these kinds of comments: like exposing them for the intellecutal frauds they are and making this guy a social pariah.

And the fact is, there will always be those who will agree with these opinions because they also hold them. Asshattery will always have its defenders.

An open and vigorous debate is the best defense, not arbitrary and punitive action.

See now people just need to not take his classes and if they get placed in his class to then drop it based on view point. Then the university could drop him because he won't be bringing in student money to them.

If you want to go that route, go all the way: register for his class, then drop it on the last day they won't charge you. That maximizes the chance that your seat won't get filled.
