  • Morality clause prevents same sex couple from living together

    From Texas, the Washington Post.

If I dug I could probably find where hetero couple has been affected by this, but they can just get married. I'm not certain if it's standard language in all divorce papers in Texas, I'd have to look at mine. Though in my case the shit storm would come when/if we get married. Our exes are bitter vindictive people.

That's what it sounds like in this case, and ex angry because she divorced him.

The ex doesn't have to be bitter. He could just be a bigot.

I do hope that they have the fortitude to appeal this and take it as far as it needs to go. It's unlikely to change any time soon unless it's taken up the chain.

This is one of many, many reasons that I say, "Fuck Texas," heartily.

Bigot or bitter, he's still a dick.

He's probably pissed his wife left him for another woman. Feeling a little unmanly. So he uses the divorce decree to punish the ex.
Good news! Your insurance company says they'll cover you. Unfortunately, they also say it will be with dirt.

This was bad enough as it was, but IIRC, there was also a decree imposed that nobody could be in the mother's house after 9 p.m. unless it was somebody she was legally married to. What the FUCK? What is this, the state playing Big Daddy and imposing curfews??

Why would you do something that awful to Mexico?

On constitutional grounds, how is this law enforceable without engaging in an unreasonable search?

It would be telling in how many heterosexual couples breaking this clause get in trouble over it.

Telling what, though? Telling how many people with custody of the kids end up with vengeful prick exes?

As Nekojin mentioned in other threads (having a mother who practiced family law), it's very common for exes to pull all sorts of vindictive shenanigans using the children as pawns. Merely forcing them to live in separate residences is actually incredibly tame when so many will resort to things such as accusing the other parent's new romantic interest of sexual abuse.

The only reason the sexuality of the affected parties is at issue is because they cannot marry and get around the situation that way.

It's a civil matter, not criminal. The ex can hire a private detective to watch the house and take pictures or video to show the lover is in the house. Courts accept that kind of thing as long as no laws were broken (trespassing, etc).
