To me, it's ridiculous to apply the same level of "seriousness" to both. (Yes, I know that US law seems very firmly adhering to all-or-nothing, zero-tolerance policies)
BTW: In most of the USA the BAC limit for DUI is 0.08. That's a pretty high limit compared to European Countries, many of which go down to 0.05 and some even as low as 0.01.

Under these circumstances, losing your license for one year already seems like a very harsh punishment to me.

It is well established that as the BAC rises, judgement becomes impaired, and reflexes and motor controls are decreased exponentially. That's why we use the BAC: it is an accurate measurement of impairment. The higher it is, the more impaired you are.
Data clearly shows that since the BAC in the US went to .08, the number of drunk driving deaths went significantly down. It works.
Simply being on the road with a BAC of .08 or higher is putting other people in danger. She doesn't have to crash into another car. She can crash into other people; pedestrians, cyclists, even into a home or other standing structure. It happens all the time.
Or she could hit a tree and hurt HERSELF.Good news! Your insurance company says they'll cover you. Unfortunately, they also say it will be with dirt.
