    Never mind the birth mother wants the infant with the couple. Or the state's various child welfare agencies. Nope, he's got "studies" that say the infant would be much better off with a hetero couple.

    I'm so sick of this sort of bullshit from those who are supposed to be impartial advocates of the law.

    ... that judge is an absolute moron.

    1. in cases like this, IIRC, the judge is ruling on if the adoptive parents would be better for the child than their biological parents- there being another family that would be even better is only relevant if the judge is asked to choose between prospective adoptive claimants.
    2. there may be studies saying kids do better with heterosexual parents. Are those studies paid for- or done by- organisations that, shall we say, are opposed to gay people? If so, then they should be gone over with a fine-toothed comb.
    3. for all we know, there may well be quite a lot of studies saying the exact opposite. If you are going to rule based on statistical evidence, then make sure you are looking at all the relevant research,
    4. I thought judges were supposed to impartially rule on a case based on the evidence presented- NOT introduce evidence of their own. For that matter, since absolutely nobody involved except him even disagreed, why did this even need to have a hearing? There's no point to argue on.
    5. He is supposed to rule based on Utah law- which is silent either way on if gay couples can adopt- not on his personal biases.

    In short, that judge should at least be barred from sitting on cases like this, if not removed from the Bench.

          This is what happens when we let states create laws to discriminate. It's times like this where the federal government needs to step in and slap them down.

            Given this happened in Utah, surprised (in a good way) that there was a backlash against this absurd decision.

                Except, in this case, there was no law. Nothing in Utah law said that the couple couldn't or shouldn't adopt. This was probably a routine adoption hearing until the judge decided to apply his own opinion to the case.
