  • And, in fact, in some jurisdictions, even if you are inside on your own property, but can be seen clearly (through a window, for example) you can be charged with indecent exposure. Especially if it's a child who sees you.

    • That has the additional risk of having to register as a sex offender if the cops are called in depending on the specific laws of the area, especially if she's seen by a child.

Uh, yeah, Red Panda, you might want to take some time to think of an alternative defense . . . just in case that one doesn't happen to pan out.

LOL she would just scream how she was above the law while being taken away naked in handcuffs. Now that would be funny

That I don't agree with. If you are inside you should be able to do whatever you want and anyone looking IN THROUGH WINDOWS can just deal. It's one thing to be outside where people can't avoid it and quite another to be inside where people have to make an effort to look inside through your window.

Why not just keep the curtains/blinds shut? Part of their purpose is to keep people from being able to look through windows. Especially if you live in an apartment complex, where it's entirely possible that at some point, your open window will be in someone's line of sight without them having to do more than walk down the sidewalk.

How do you plan to explain to the cops that they should just look away?
I except the cops to laugh at them over the complaint that somebody is checking the weather and is on their balcony for nearly several seconds. What are the cops even going to do? Teleport to my apartment before I go back inside? Stake it out- I hope they are busier then that.

                My question remains to her.

Why does she feel she's entitled to be outside naked, (despite it being against the law), but she doesn't feel that fat people can do the same?

She's stated she's very angry that /fat/ people get treated /special/ treatment, and that everyone needs to follow the same rules.

So, by strutting around naked, while denying /fat/ people, is pretty much giving herself special treatment and not fair treatment to all people.

Reading is fun. You should try it. Start with posts where I said they can do it but shouldn't because they should be ashamed of what they have let themselves become.

                • The cops don't have to stake out your place. If they get a complaint that you're coming outside naked or topless regardless of how long you're out there, they may come by to have a talk with you, regardless of whether you're still naked or not. Especially if whoever makes the complaint says it's an ongoing thing, happening on a regular basis.

Something along the lines of "We've recieved some complaints- apparently you've been making a habit of being nude on your balcony where other people can see you..."

You don't have to be caught in flagrante dilecto to be charged with a crime.

                  • I doubt she would get fined the first time. Just a talk about what she is doing is illegal. Especially if the cops don't witness it themselves.

Ok, but before your neighbor spoke to you, did she or her husband know you were checking the weather? Probably not. All they knew is you were out on your balcony, where other people could see you, with no clothes on.

As has been stated, the police don't actually have to see you in order to respond to a complaint. And, if your neighbor does decide to call on you one day, I doubt the police will just laugh them off once they tell them they spoke to you about the matter and you told them you didn't care.

That's your argument. It doesn't have to be theirs.

All your neighbors have to do is tell the police that they've seen you standing naked on your balcony several times, and that you've been continuing to do so after they asked you to stop.

Somehow, I don't think that the police are going to laugh that off.

I think I can guess what the police will say if you tell them that you're just checking the weather :

"Naked? Ma'am, couldn't you put on a robe or something before doing that?"

Frankly, I don't think that the police are going to care why you're breaking the law, or how long you do it, especially when there is a very easy way for you to accomplish your task (checking the weather) without doing anything illegal.

As Amanita pointed out, the police don't have to actually catch you in the act, just to have a word with you about it. All they need is a complaint from your neighbors.

Besides, what makes you think that the police are the only people who know how to use a camera?

If your neighbors get upset enough to call the police, then there's a fair chance that they'll try to get a little evidence to back up their complaint first. All they need to do is take a picture of you standing on your balcony naked. If you do it every day, it won't be all that difficult.
